1. Who these terms are between
These Terms of Service govern your use of merchixllc.com and any purchase you make from it. The site is operated by MERCHIX LLC, a limited liability company registered in the State of Wyoming, United States, with its registered address at 30 N Gould St Ste R, Sheridan, WY 82801 ("MERCHIX", "we", "us").
By browsing the site or placing an order you accept these Terms. Please read them before you buy.
2. What we sell
MERCHIX LLC is a direct-to-consumer online retailer of physical consumer goods: custom printed and embroidered apparel, drinkware, bags and everyday accessories. All items are produced to order by print-on-demand production partners in North America and Europe and shipped direct to the customer. We do not sell digital goods, services or subscriptions.
3. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that the payment method used is lawfully yours to use.
4. Products, descriptions and images
- We describe every product as accurately as we can, including material, weight and fit.
- Because garments are cut and printed individually, small variations in print placement, colour and measurement are normal and are not defects.
- Colours may appear differently between screens. A difference in on-screen colour rendering is not a fault.
- Availability is not guaranteed. If a product becomes unavailable after you order, we will tell you and refund you in full.
5. Prices and payment
- All prices are shown in US dollars (USD) and exclude shipping and any applicable sales tax or VAT, which are calculated and displayed before you pay.
- Payment is taken at the time of order through a third-party payment processor. We do not receive or store your full card details.
- We reserve the right to correct pricing errors. If an item was listed at an obviously incorrect price, we will contact you before producing the order and you may confirm at the correct price or cancel for a full refund.
- If a payment fails or is reversed, we may cancel the order.
6. Orders and acceptance
Your order is an offer to buy. A contract is formed when we send you an order confirmation email. We may decline an order where the item is unavailable, the address cannot be served, payment cannot be verified, or we reasonably suspect fraud. If we decline, you are refunded in full.
7. Production and delivery
Production takes 2 to 5 business days before dispatch, and delivery times run from dispatch. Published times are estimates in good faith and are not guaranteed dates. Risk in the goods passes to you on delivery. Full detail is on our Shipping & Delivery page, which forms part of these Terms.
8. Returns, refunds and cancellation
Our Returns & Refunds policy forms part of these Terms and sets out your 30-day return window, what we cannot accept back, who pays return postage and how refunds are issued.
9. Custom artwork and personalisation
Where you supply artwork, text or images to be applied to a product, you confirm that you own the rights to it or are licensed to use it, and that it does not infringe any trademark, copyright or other right, and is not unlawful, defamatory, hateful or obscene.
You indemnify MERCHIX LLC against any claim arising from artwork you supply. We may refuse or cancel any order whose artwork we reasonably believe infringes a third party's rights or breaches clause 10, and will refund it in full.
10. Acceptable use
You may not use this site or our products to produce or distribute content that is unlawful, infringes intellectual property, promotes hatred or violence against any group, harasses an individual, is sexually explicit, or is designed to deceive. We may refuse service where any of these apply.
11. Intellectual property
The MERCHIX name, logo, site design, product photography and written content are owned by MERCHIX LLC and may not be reproduced without written permission. Artwork you supply remains yours; you grant us a limited licence to reproduce it solely to manufacture and deliver your order.
12. Warranties and disclaimers
We warrant that goods will be as described, of satisfactory quality and fit for their ordinary purpose. Beyond that, and to the maximum extent permitted by law, the site and products are provided without further warranties of any kind, express or implied.
13. Limitation of liability
To the maximum extent permitted by law, our total liability for any order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss, including loss of profit or loss of opportunity. Nothing here excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. Nothing in these Terms affects your statutory consumer rights.
14. Events outside our control
We are not liable for delay or failure caused by events beyond our reasonable control, including carrier disruption, natural disasters, industrial action, epidemics, or acts of government. Where such an event causes significant delay you may cancel any undelivered order for a full refund.
15. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law rules, and the courts of that State have exclusive jurisdiction, save that consumers may bring proceedings in their country of residence where local law gives them that right.

16. Changes
We may update these Terms. The version that applies to your purchase is the one published when you place your order. Changes are never applied retroactively to an order already confirmed.
